Even in this seemingly permanent recession, government is intensifying its regulation, taxation and harassment of regular business people. Business pages are filling up with pleas to government from real-life entrepreneurs. All these people are saying is give freedom a chance.

An example is Seth Gordon, the co-founder and ?TeaEO? of Honest Tea, which makes fabulous drinks that come in 16.9 ounce bottles. The tea sells very well but runs headlong into the latest absurdity of regulatory control from the New York mayor?s office.

Supposedly waging war on obesity, Mayor Michael Bloomberg wants to ban for sale in eating establishments all drinks with more than 25 calories per 8 ounces. Honest Tea, founded to be a healthy alternative to soft drinks, misses this mark by 10 calories per serving.

This means that this low-calorie drink is a direct target of the police power of the state. It?s the new prohibition?against tea! Amazing.

This puts the company in a terrible position. They already had purchased several hundred thousand dollars worth of 16.9 ounce bottles, and it seems crazy to throw that away completely a adopt a smaller size, especially given that the regulation could be arbitrarily changed yet again.

In any case, as I read Gordon?s plea for the life of his company, the obvious occurred to me. Let?s say you reduce the bottle size. Thirsty people might end up buying two, thereby defeating the whole point of the regulation, and creating another supposed problem of trash proliferation. Given prevailing environmental consciousness, don?t large bottles make sense?

Now, to be sure, Godon is not sure what the right size of the bottle ought to be. But he is pretty sure that politicians don?t know the answer to that either. ?As a beverage marketer, we willingly submit to the unforgiving judgment of the market,? he writes in the Wall Street Journal. ?What we did not anticipate was an arbitrary decision to constrain consumer choice.?

There are about a million problems with this approach to controlling obesity. The notion that drinks are the problem is absurd, and, very strangely, the legislation itself seems to exempt milkshakes and liquor. Regardless, the problem of being too fat is as unique to individuals as are the solutions. You can?t force people to be thin, not in a developed economy where leisure is a default, the majority work at desk jobs, and high-calorie food is plentiful.

At the same time we have a nation-wide war against fat, there is another ongoing culture war against too thin as well. Anti-anorexia activists are busy harassing magazines that feature too many thin models, and denounce super-model agencies and beauty pageants for driving girls to absurd lengths to shave off the pounds.

How close are we to have an official nation-wide mandatory pound-per-height ideal that everyone but politicians must adhere to? I tell you, there are people out there who would push the button to make this happen if they could get away with it.

What makes me absolutely nuts is how elected officials today imagine that government should have any power over these matters at all. What does the idea of freedom mean if not the freedom to eat and drink and determine one?s own resulting physique? I would say that same about the pills we take, the plants we smoke, the books we read, and every other aspect of life that is not injurious to others.

A few days before this article on tea appeared, there was another sad article along the same lines, by Henry Juszkiewicz, the CEO of Gibson Guitar. Last year, his office was raided by the G men. The federal agents took 100 guitars, many boxes of raw materials, traumatized workers, and cost the company several millions in profits. They had no clue what was going on.

Why? The reason has to do with some environmental regulation on the use of woods that go into making quality fingerboards. The wood is from India, a regulation that says that the wood must be finished before being imported, whereas Gibson Guitar finishes the wood in the U.S. It further turns out that two different regulatory agencies disagree on precisely how to implement this legislation.

How can any company possibly keep with all the arbitrary laws and arbitrary enforcement? The Gibson company has been fighting hard for its reputation and trying its best to avoid the label of being a bad citizen. But at least it has been fighting!

Juszkiewicz wrote in the Wall Street Journal as follows:

In America alone, there are over 4,000 federal criminal offenses. Under the Lacey Act, for instance, citizens and business owners also need to know?and predict how the U.S. federal government will interpret?the laws of nearly 200 other countries on the globe as well. Many business owners have inadvertently broken obscure and highly technical foreign laws, landing them in prison for things like importing lobster tails in plastic rather than cardboard packaging (the violation of that Honduran law earned one man an eight-year prison sentence).

Plenty of other business face regulatory harassment on a daily basis but never go public with complaints, for fear of being targetted. It is impossible to find any physical product on the shelves that is not subject to thousands of regulatory mandates. There isn?t a service in the above-ground economy that is not similarly regulated.

In some ways, the adaptations that business undertakes ends up discrediting business itself. The new and improved refrigerator, oven, or lawnmower ends up being a degraded project that doesn?t work as well as the old one, but the business fears pointing out it out because it doesn?t want to face the consumer backlash. So they all continue to act as if life is normal.

But life is not normal in the one-time land of the freed. You can investigate this for yourself and observe that reality is exactly the opposite of what President Obama says. Far from making enterprise possible in the first place, the major result of the regulatory state is to establish barriers, introduce restrictions, add an element of fear, and move the rules around in a way that makes enterprise increasingly difficult.

U.S. business today faces a comprehensive and devastating central plan that is systematically driving economic dynamism to a grinding halt. One only needs to compare the innovation that takes place in the relatively less regulated digital world with that imposed upon the physical world that tea makers and guitar manufacturers inhabit.

If there is to be a new tea party, it shouldn?t be dumping tea but dumping the regulators who are trying to restrict our rights to drink it however we want it.

Artifical mother of pearl follows nature's recipe

Researchers have made an artificial version of mother of pearl - a material found on the inner shell of some molluscs that forms the outer coating of pearls - by mimicking the way it is created in nature, paving the way for tough coatings made using low-cost materials.

Mother of pearl, also known as nacre, is a composite material made from inorganic layers of calcium carbonate separated by organic polymers such as chitin. This structure gives nacre its iridescent sheen and makes it resilient to damage.

The breakthrough could perhaps give firms a way of coating smartphones or other gadgets that are shiny and nice to look at - but are still incredibly tough.

Previous attempts at creating artificial nacre have mimicked these properties, but have not used the materials that make up the genuine article. These efforts have resulted in something that was strong - and which could be used to provide lighter body armour, for example - but which never looked anything like real nacre. Now, researchers at the University of Cambridge, UK, have created their own calcium carbonate-based nacre by copying the way it grows naturally, publishing details today in the journal Nature Communications.

First, they repeatedly dipped a glass slide in two solutions of organic polymers to create a thin film, which then underwent another process to create tiny pores within the material. Next, they dipped the slide in an organic polymer solution containing calcium and magnesium ions in a similar ratio to those present when nacre forms naturally, creating the calcium carbonate layer.

Finally, they crystallised both materials, and repeated the process to create a stack of alternating organic and inorganic layers, much like natural nacre.

Men are slow to seek medical advice | Aventura

Men are 24 percent less likely than women to have visited a doctor in the last year. Why do I bring that up now? Because June was Men?s Health Month. And men need all the reminders we healthcare professionals can deliver. In all my years at CHI, I?ve seen how often our South Florida patient base reflects the nationwide pattern. Men are slow to seek medical advice and help, despite today?s improved and effective procedures. Men at least should be screened for such common problems as diabetes; high blood pressure; high cholesterol; prostate, colorectal and skin cancers; and HIV and sexually transmitted infections.

Too many men adopt a so-so approach to good health care at an early age and change little all the way to retirement age. That casual approach to prevention puts a larger burden on the health care system. The worse cases involve violence and addiction. Today?s economic conditions add to the ?silent crisis? many men go through as they try to tough it out at home and at work.

It?s common for the issue to spread to friends and family. Women see the impact on the important men in their lives who put off seeking medical help. That neglect creates another statistic ? women outlive men by more than five years. Older women are three times more likely to be living alone. There are more women in nursing homes and more living in poverty, because their husband died early. There?s another burden on the health care system ? those widows more likely need public assistance. And I?m sure that many would like to have had their husband around for those later years.

French music group accuse Google of encouraging piracy

The French Supreme court has ordered Google to delete the term ?torrent? from their autocomplete search feature.

An on-going case with French music group SNEP and Google has escalated to the point where the music group is accusing Google of implicitly allowing copyright violations.

SNEP alleges that when a well-known French musician is typed into Google search, it autocompletes the suggestion by adding file-sharing sites.

?RapidShare and ?Megaupload? are two other terms which SNEP are trying to ban alongside ?torrent?.

Despite the courtcase, Google have already removed millions of URLs which link to copyrighted or pirated material.

2. Being honest is a business strategy. You should not hesitate to tell the deficiencies in your business. Tell them that your interests with their interests. In business, you need to convince consumers that they get more value for goods or services they paid for. Any expenditure dollars must provide a meaningful value. Therefore, the determination to serve with all my heart will be a competitive advantage.

3. Technological developments today do not allow you to lie. No matter how small the lie is done, it would unravel. May advance information technology still faces many obstacles. But now such information has grown rapidly. Your customers will share their stories through forums on the internet, or other media, about your product. They have many sources of information they can access easily and quickly. So there is no room for lying.

4. If you do not advertise your products honestly, customers who have proven a lie you will announce to prospective customers who have not even had time to buy your product. Your customers are the future of your business. Your business continuity is in their hands. You have to keep their good faith.

Mid Sussex District Council has unveiled two new outdoor gyms in Burgess Hill that will give local people a way to stay fit and active without spending a penny on membership fees.

The new outdoor gyms are located at Fairfield Recreation Ground and St John?s Park. Local residents are now able to try out a range of equipment including, a treadmill, a chest press and lat pull down, parallel bars, street fitness bikes and balance discs for Tai Chi. In total, eight pieces of low impact, resistance based equipment have been installed in the two Burgess Hill parks. The open air gyms are free to use and are safe for people of all ages who are looking to boost their health and fitness.

Mid Sussex now benefits from eight free outdoor fitness equipment areas, which are located right across the district. Local people can try an open air workout at:

A heat wave will continue for the Eastern Valleys, while scattered showers and thunderstorms are expected to develop Sunday from the Northern Plains th rough the Midwest.

A cold front over the Ohio River Valley and Northeast will slowly pull southeastward. This will allow for widespread showers and thunderstorms to spread from the Ohio River Valley through the Mid-Atlantic states. There is a slight chance that these storms will turn severe with strong winds and large hail.

Behind this system, another low pressure system is moving away from the northern Rockies and into the northern Plains. This will produce a warm front that extends eastward, kicking up scattered showers and thunderstorms across the Dakotas and upper Midwest. Just ahead of this system, a smaller trough of low pressure will move across the Midwest, triggerin g widespread thunderstorm activity.

In the Southeast, a high pressure ridge over the Gulf states will continue pushing warm and humid air in from the Gulf of Mexico. This will maintain high temperatures, with excessive heat warnings and heat advisories stretching from the Mississippi River Valley through the Eastern Seaboard. Some areas will see highs in the lower 100s again.

In the West, a trough of low pressure will move from the Pacific Northwest, over the intermountain West, and into the northern Rockies. This will kick up scattered showers and thunderstorms throughout the day. To the south, monsoonal moisture over the central and southern Rockies will increase chances for showers and thunderstorms.

Temperatures in the lower 48 states ranged Saturday from a morning low of 30 degrees at Stanley, Idaho to a high of 109 degrees at Smyrna, Tenn.

On July 5, NASA will launch a mission called the Solar Ultraviolet Magnetograph Investigation or SUMI, to study the intricate, constantly changing magnetic fields on the sun in a hard-to-observe area of the sun's low atmosphere called the chromosphere.

Magnetic fields, and the intense magnetic energy they help marshal, lie at the heart of how the sun can create huge explosions of light such as solar flares and eruptions of particles such as coronal mass ejections (CMEs). While there are already instruments both on the ground and flying in space that can measure these fields, each is constrained to observe the fields on a particular layer of the sun's surface or atmosphere. Moreover, none of them can see the layer SUMI will observe.

"What's novel with this instrument is that it observes ultraviolet light, when all the others look at infrared or visible light," says Jonathan Cirtain, a solar scientist at NASA's Marshall Space Flight Center in Huntsville, Ala. and the principal investigator for SUMI. "Those wavelengths of light correspond to the lowest levels in the sun's atmosphere, but SUMI will look at locations higher in the chromosphere."

This higher layer of the chromosphere is known as the transition region because the chromosphere transitions here into the part of the sun's atmosphere called the corona -- and it is a region that is dominated by the magnetic fields and in which solar material heats up dramatically forming the corona and the base of the solar wind. Understanding the structure of the magnetic fields in this region will then allow us to understand how the corona is heated and how the solar wind is formed. It is also an area believed to be where flare accelerated particles originate, so understanding the processes at play in the transition region can help with models to predict such eruptions on the sun.

To measure magnetic fields in the chromosphere, SUMI will observe the ultraviolet (UV) light emitted from two types of atoms on the sun, Magnesium 2 and Carbon 4. Through established methods of measuring how the light is affected as it travels through the magnetic environment of the solar atmosphere towards Earth, scientists can measure the original strength and direction of the magnetic fields, thus creating a three-dimensional magnetic map of the region.

This trip for SUMI is largely a test flight to make sure the instrument works and to assess possible improvements. The instrument flew once before in July 2010 but experienced a much higher G-force than expected, which broke screws holding the main mirror in place so it could not gather accurate data. The team has now reinforced the mirror.

"With the knowledge we get from a successful SUMI mission, we can go on to build space-based instrumentation that will help us understand the processes that form flares and CME's and help us predict space weather," says Cirtain.

SUMI will launch from White Sands Missile Range in New Mexico on a Black Brant rocket. The flight will last about eight minutes total.

MIAMI (AP) - Hanley Ramirez picked a good time to end his home run drought.

Ramirez hit his first homer since June 3, ending his drought at 89 at-bats with a two-run shot in the eighth inning in a 5-2 victory over the struggling Philadelphia Phillies on Sunday.

"We've been waiting for Hanley's big day," Marlins manager Ozzie Guillen said.

The Marlins completed a three-game sweep of the Phillies for the first time since August 7-9, 2009, at Citizens Bank Park. The Phillies have lost five straight.

"We are trying to beat everybody, but especially in our division," Ramirez said. "If you want to move up, that's what you have to do."

All-Star slugger Giancarlo Stanton also homered, and Omar Infante and John Buck each had RBI doubles for the Marlins, who have won four straight as they look to put an 8-18 June behind them.

"June, get far away from us," Stanton said. "It's good to start new and just move forward."

Ricky Nolasco (7-6) pitched seven strong innings, striking out six and allowing five hits and two runs.

"A sweep against anybody is big, but we know how good that team is and we're trying to prevent them from getting on a roll as well," Nolasco said.

Nolasco improved to 8-4 with a 3.59 ERA over 14 starts against the Phillies.

"He's always been a better pitcher than people give him credit for," Phillies manager Charlie Manuel said. "I've seen him pitch some real good games over the time I've been here."

With the Marlins leading 3-2 in the top of the eighth, Steve Cishek allowed two singles before getting Shane Victorino to fly out to end the inning.

Ramirez's two-run homer came off Antonio Bastardo in the bottom of the eighth to extend the lead to 5-2.

"The biggest hit today was the home run by Hanley," Guillen said. "Hanley opened up the game a little bit to give you some room for a mistake."

Ramirez said: "It was good for the crowd."

Heath Bell came on in the ninth for his 17th save in 21 chances.

Philadelphia starter Joe Blanton (7-7) allowed three runs and six hits in six innings. He struck out seven.

"If we go out and throw a good game, we have trouble scraping across a couple (runs) and that's just baseball," Blanton said. "Sometimes it goes that way."

After Juan Pierre tripled and scored on a groundout by Carlos Ruiz, Miami took a 2-1 lead on consecutive RBI doubles by Infante and Buck.

Stanton's third home run in five games - his 19th overall - gave Miami a 3-1 advantage in the third. Nolasco, who had retired 11 straight at one point, was charged with two wild pitches in the sixth, which resulted in the Phillies' second run.

NOTES: The Phillies have had at least three All-Star selections in four consecutive years as LHP Cole Hamels, RHP Jonathan Papelbon and C Carlos Ruiz were selected to represent the National League on July 10. ... How Obama, Romney are spinning court's health-care ruling

Republicans and Democrats are putting their political spin on the US Supreme Court's historic and startling decision on the Affordable Care Act. As they head toward the presidential election, both Barack Obama and Mitt Romney have major challenges in interpreting the law.

Ever since the US Supreme Court issued its startling decision on the Affordable Care Act (ACA) Thursday morning, the presidential campaigns of both Barack Obama and Mitt Romney have been spinning the ruling like crazy.

Just some of the issues with wildly different political interpretations include: Defining the details and impact of what the court says plainly is a form of taxation ? the basis, in fact, of the constitutionality of what critics call ?Obamacare.? What the outcome would be for Medicare. The number of already-insured Americans who would have to scramble to find new health care coverage. Whether or not the ACA is a ?job-killer.? Whether or not the deficit would go up or down as a result of this landmark legislation.

Obama may have won big in the high court ? ?Did Obama Just Get His Mojo Back?? asks the headline on a piece at Slate ? but both the President and his likely GOP competitor have major political challenges as a result of the ruling.

For Obama, it?s the ACA?s cost to individuals and families of a massive new government program designed to reform health care insurance in major ways, and Republicans were quick to jump on that.

In the GOP?s Saturday radio address, Sen. John Barrasso, R-Wyo. (who?s a physician) said this:

?President Obama has repeatedly promised, and I quote, 'if you're a family making less than $250,000 a year, my plan,' he said, 'won't raise your taxes one penny.' Now, all of America knows the truth. The President's health care law hires more IRS agents to investigate you and to make sure you buy insurance ? but it fails to deal with the shortage of nurses and doctors to actually take care of you.?

The Supreme Court?s majority opinion did say the ACA is constitutional because of Congress?s taxing authority, so that?ll take some explaining by the Obama administration.

What Romney has to explain is why that?s substantially different from his signature achievement as governor of Massachusetts: A statewide health insurance program that includes an individual mandate and the taxing authority to enforce it.

?I don't think of the mandate as a tax ? I think of it is a free rider penalty,? Jon Gruber, the MIT economist who helped craft the Massachusetts and national laws, told Politico.com. ?But if you want to think of it as a tax, then it is exactly the same tax ? Romney imposed.?

Michael Widmer, president of the Massachusetts Taxpayers Foundation ? a business-backed fiscal watchdog that has analyzed the state?s health care law for years ? agreed, Politico reported. ?If one?s a tax, the other?s a tax,? he said.
